1. What WA Dukan is

WA Dukan is a tool that lets a seller build a simple online store and receive customer orders on WhatsApp and in a dashboard.

We are not the seller or buyer of any goods or services, and we are not a payment provider between sellers and customers. Every sale is a contract only between the seller and the customer. We do not take part in, guarantee or handle payment, delivery, returns or refunds of those sales.

2. Your account

• You must be 18 or older, or of legal age to make a contract where you live.
• Give true information: your real brand name, a valid email and a WhatsApp number you control. Keep them up to date.
• You are responsible for your password and for everything done through your account. Tell us at once if you think someone else has used it.
• Do not open new accounts to avoid a suspension or a plan limit.
• We may ask you to prove who you are or that your brand and products are real.

3. What you may sell

You promise that everything you list is legal to sell and deliver in the places where you sell it, that you own it or have the right to sell it, and that your descriptions, photos, prices and stock are true and not misleading.

4. What you must NOT sell or do

You must not list, offer, promote or arrange the sale of any of the following on WA Dukan:

• anything illegal, stolen, or obtained by fraud;
• illegal drugs, narcotics and other controlled substances, and equipment made to use them;
• weapons, firearms, ammunition, explosives, and anything made to hurt people;
• counterfeit, fake or imitation goods sold as the original, or goods that copy another brand, design or trademark without permission;
• prescription or unlicensed medicines, unlicensed medical devices, and false health or cure claims;
• alcohol, tobacco, vapes and gambling items where their sale is restricted or against the law;
• nudity, sexual or sexually explicit content, images or services of any kind, and anything that harms, sexualises or involves children;
• human beings or organs, endangered animals or wildlife products, and protected cultural items;
• pirated software, films, music, books or exam papers, and stolen data such as personal information, accounts or cards;
• hazardous, toxic or recalled products;
• anything that promotes hate, terrorism, violence or discrimination;
• scams of any kind, such as fake investments, pyramid or get-rich-quick schemes, money doubling, or unlicensed lending.

You must also not:

• take payment and not deliver, or mislead customers about price, quality, delivery time or returns;
• harass or abuse customers or anyone else, or use customer contact details to send spam;
• ask customers for card details, PINs, passwords or one-time codes;
• upload viruses, try to break into the platform, scrape it, overload it, or get around its limits and security;
• use WA Dukan to break any law, or use our name, logo or badges to suggest that we endorse you.

5. Orders, payments, delivery and refunds

• Orders are sent to you on WhatsApp and appear in your dashboard. You are responsible for confirming, delivering and keeping customers informed, for a real reason whenever you cancel an order, and for keeping order statuses correct.
• Payment between you and your customers is arranged directly between you. We do not hold, collect or guarantee customer money.
• The refund policy and terms you write for your own store apply between you and your customers. They must be lawful and fair, and must not go against these Terms.
• Customers keep their rights under consumer law. Handle complaints yourself, promptly and politely.
• You are responsible for your own taxes, licences and duties.

6. Customer information and privacy

• When a customer orders, you receive their name, phone number, address and note. Use them only to handle that order. Do not sell, share, publish or use them for marketing, and keep them safe.
• We store account, store, order and visit data to run the service, keep it secure, prevent abuse and give support. We may look at order changes and cancellation reasons to check complaints or misuse. We do not sell your data.
• The service uses cookies and browser storage that are needed for login, security, the shopping cart, remembering a customer's details on their own device, and counting store visits.

7. Your content

You keep ownership of your logo, photos, text and product details. You give us a worldwide, non-exclusive, royalty-free licence to store, resize, show and share them as needed to run your store and the platform.

You promise that you have the right to use them: no pictures taken from other people or brands without permission, and no photos of people without their consent. We may remove content that breaks these Terms or the law.

8. Plans, fees and payments to us

• Plans, prices, product limits and features are shown on the Plans page and may change. A paid plan starts when we confirm your payment and lasts for the period shown.
• When a plan ends, your store may return to the Basic limits and extra products may be hidden.
• Fees paid to us are not refundable unless we say so or the law requires it.
• We may change prices and features with notice on the site or by email. Changes apply from your next renewal.
• Sending a fake or altered payment proof leads to an immediate suspension.

9. Verified badge and ratings

The Verified seller tick and the star rating are given by our team after a review, at our own discretion. We can change or remove them at any time, for example after complaints, cancelled orders or poor service. They are not a guarantee of quality by us.

10. Suspension and closing

• We may reject a new store, hide or suspend a store, remove content, or close an account at any time if we believe these Terms or the law are broken, customers are at risk, or the platform needs protection. This can happen with or without notice, depending on how serious it is, and without refund of fees.
• You may stop using the service at any time. Closing your account does not cancel your duty to complete orders you already accepted.
• For serious breaches we may report to the authorities and answer lawful requests for information.

11. Availability

The service is provided as it is and as available. We try to keep it running, but we do not promise that it will be uninterrupted or free of errors, and we may change, pause or stop features. Keep your own record of important orders and data.

12. Limit of liability

As far as the law allows, we are not responsible for lost sales, profits, data or goodwill, for disputes between sellers and customers, for the goods or services sold through the platform, or for indirect or consequential losses. Our total responsibility to you for any claim is limited to the amount you paid us in the 3 months before the event, and nothing where you use a free plan, except where the law does not allow us to limit it.

13. Your promise to protect us

You agree to compensate us for, and protect us from, claims, losses and costs (including reasonable legal fees) that come from your products, your content, your orders, or your breach of these Terms or the law.

14. Changes to these Terms

We may update these Terms. The version and date are shown at the top of this page. If a change matters, we will tell you by email or in your dashboard. If you keep using WA Dukan after a change, you accept the new Terms.

15. Governing law

These Terms are governed by the laws of Pakistan. If we cannot settle a dispute by talking, it will be handled by the courts of Pakistan. If any part of these Terms is found invalid, the rest stays in force.
